No Sale or Sharing of Personal Information

In the preceding 12 months, we have not sold or shared, as that term is defined in the California Consumer Privacy Act, any Personal Information to non-affiliated third parties without your consent.  We also have no actual knowledge of selling or haring the Personal Information of minors under 16 years of age to non-affiliated third parties without affirmative consent.

Use and Disclosure of Sensitive Information

We do not use or disclose sensitive personal information, as defined by the California Consumer Privacy Act, as amended by the California Privacy Rights Act, for purposes other than those specified in Section 7027(m) of the California Privacy Rights Act regulations.

Perfumania uses cookies to collect information around abandoned shopping carts. A cart is considered abandoned within one hour of inactivity/lack of purchase. Once the cart is considered abandoned, an SMS message will be sent as a reminder.

EU and UK Data Subjects

International Data Transfers.  We offer EU and UK Model Clauses, also known as Standard Contractual Clauses, to meet the adequacy and security requirements for our customers that operate in the European Union and the United Kingdom, and make transfers of Personal Data from those jurisdictions to the United States and other countries that lack adequacy determinations.  Please contact us as detailed in the “Contact Us” section below for more information.

Children Under the Age of 16

You have the right to request that we delete any of your Personal Information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your request and verify your identity, we will permanently delete your Personal Information from our records, unless a legal exception to deletion applies.  In our response to your request to delete, we will specify the manner in which we have deleted your Personal Information or, if we must deny your deletion request, the basis for this refusal.

Authorizing an Agent

Verifying Your Request

We cannot respond to your request or provide you with Personal Information if we cannot verify your identity or authority to make the request and confirm the Personal Information relates to you.  Making a verifiable consumer request does not require you to create an account with us.  We will only use Personal Information provided in a verifiable consumer request to verify your identity or authority to make the request.  

To verify your identity, we ask that you provide us with the following information when you submit your request:  (1) first name, (2) last name, and (3) phone number or email.  We will use the above information to verify your identity.  We will require additional information to verify your identity and fulfill your request depending on your type of request or the information requested by you. 

Appeals Process

You may appeal a decision by us to decline to take action regarding your request.  To do so, please send an email message to privacy@perfumania.com within seven days of receiving notice from us that your request has been declined.  We will respond regarding any additional action taken within the legally appropriate time. 

Financial Incentives and Non-Discrimination

We may offer you financial incentives, as defined by the California Consumer Privacy Act, when you enroll in Perf Perks.  Perf Perks is a loyalty program in which participants are awarded points for every dollar spent; these points are redeemable against future purchases. For details of our current Perf Perks and its terms, including how to opt-in or opt-out of the program, as well as the benefits of the program, please refer to https://perfumania.com/pages/reward-page and https://perfumania.com/pages/perks-program-terms-and-conditions.  Participation in our rewards program is optional, and you can opt-out of the program (i.e., terminate participation and forgo the incentives) by following the instructions in the program’s descriptions and terms.  Solely for purposes of complying with the California Consumer Privacy Act, we estimate that the value of a consumer’s data related to Perf Perks to be, on average, [$0.19] per program member.  We have calculated the value of a consumer’s data by taking the revenue and subtracting the customer acquisition costs.

California Shine the Light Law

This Privacy Policy describes how Perfumania and its affiliates and subsidiaries (“we”, “our”, “us” or “Company”) may collect, use, and disclose personal information of visitors when you participate in any of our “Alerts” programs, which includes text message (SMS , MMS) alerts sent by an automatic telephone dialing system or email alerts or notifications (“Alerts” and together with the “Site” collectively, “Services”).

We collect information you provide directly to us. For example, we collect information when you participate in our Alerts program, or otherwise communicate with us. • Opting-In. Additionally, participating brick and mortar stores may offer the ability to opt-in and provide a mobile device number. Alert frequency will vary. By providing your email address and mobile telephone number you hereby consent and agree to: (a) receive reoccurring Alerts to the mobile telephone number that you provide when you sign up for the Services or any other number that you designate you, and (b) consent to receive promotional and other informational emails. Your consent to receive Alerts, including promotional messages, is not required to make a purchase.

• How to Opt-Out. You may opt-out of receiving SMS text message Alerts by sending “STOP”or “UNSUBSCRIBE” to 71385.
